Spoliation and the Claims Adjuster: Evidence taken in the course of a forensic fire investigation is a critical element to proving the investigator’s findings. However, that very same evidence [if improperly taken, secured or handled] can destroy an otherwise sound case. We will explore the issues involved in fire related litigation when evidence is in the mix; highlighting considerations in taking/securing/testing evidence and discusses tactical issues when evidence is taken by an adverse party. The spoliation issues discussed are equally applicable to any type of claim (Auto or Property) in which evidence is involved. Fire and Explosion Investigations That Sizzle: Visually compelling cases will illustrate effective forensic fire investigations. The discussion evolves to the evaluation of the expert and their findings. The insurance claims professional’s responsibilities extend beyond the technical ability to resolve issues of coverage, liability and damages. The process of investigation, evaluation and resolution is one that relies on good judgment to discharge contractual responsibilities to the insurance customer. The insurance claims professional’s responsibilities include the demanding challenge of evaluating the technical abilities of experts. We will provide tools and perspective for successful evaluation of experts.

About the Speakers:

Matthew Wilke, IAAI-CFI, is a Certified Fire Investigator through the International Association of Arson Investigators. The IAAI-CFI is recognized as the “Gold Standard”in our industry. Matthew concurrently holds a position of Fire Captain and fire investigator for the City of Bismarck, ND while he also conducts fire investigations for Fire Cause Analysis over the last 5 years. He has over 23 years of fire service experience including: firefighting, investigation and EMT services. Matthew has been responsible for origin and cause investigations for the past 18 years and has been involved in multiple fire investigations in residential, commercial and automotive fires. Matthew is in charge of department training for the
City of Bismarck Fire Department Investigations team. He is a graduate of University of Mary with a Communications degree.

Karl Nesler, CIFI, AIC, FCLA, PCLA, retired from State Farm Insurance Companies after over 28 years. For the last 18 years of his insurance career, Karl handled special investigations in the upper Midwest. During this time, Karl gained extensive experience resolving automobile, homeowner, commercial property, and personal injury claims. He led comprehensive enquiries; analyzed damages, causation, and potential fraud. He collaborated with insurance agents, repair professionals, and attorneys to interpret policies and determine proper settlements. Karl’s areas of expertise include: Fire investigations, Evidence Handling, Interviews, Subrogation, Property & Fire Claims, Fraud Investigation, Damage Appraisal, Settlement Negotiation, Liability Analysis, Customer Service, Report Evaluation, Detailed Documentation, and Legal Testimony. Karl has testified in local, state and Federal – civil and criminal courts.
